Premises accidents (include slip and fall accidents, dog bite
accidents, incidents attributed to safety and security lapses, and
exposure to toxic substances)
are a significant number of the cases we see. The most common of
these are "slip and fall" accidents. One of the conditions
that a victim of a premises accident must show is that the property
owner was aware of the hazard that contributed to your accident, failed
to alert potential victims of the hazard, and was
negligent in correcting the hazard before the occurrence of your
accident. The accidents can occur in places of business, on
public property, and on private property.
Some of the conditions that contribute to premises accidents for which
lawsuit funding can be obtained include
(but are not limited to) the following.
- spilled liquids on floor
- persistent wet conditions leading to mold growth
- unsafe work-site conditions affecting passers-by and
employees at the work site
- falling merchandise in warehouse-type stores and other
retail stores
- falling objects such as TV's in bars and restaurants
- failure to comply with building codes and fire safety laws
in apartment buildings and rental properties
- failure to correct safety hazards in a timely manner in
apartment buildings and rental properties
- inadequate building security that allow assaults to occur
to building occupants and visitors
- unburied TV cables on the ground
- holes in the ground left unmarked by utility or
construction companies
- stairways without safety railings
- building corridors and stairways with poor lighting
- poorly maintained carpeting and flooring in buildings
- poorly maintained sidewalks or parking lots
- improperly restrained dogs
- inadequate swimming pools security and safety precautions
The types of injuries that qualify for premises accident lawsuit
funding
include (but are not limited to) the following.
- herniated spinal disks
- bone fractures
- lacerations from dog bites
- respiratory problems attributed to exposure to toxic substances in the air such as mold or chemicals
- shoulder injuries (e.g. rotator cuff and torn muscles)
- knee injuries (e.g. torn meniscus, torn ligaments)
- burn injuries
- eye injuries
- head injuries
- an injury requiring surgery
- loss of body part (e.g. amputations)
- injuries resulting in death
- soft tissue injuries (the advances on soft tissue injuries
are usually
smaller if these are the most serious injuries in the case because the
overall case value is lower)
The following cases do NOT
qualify for premises accident lawsuit funding.
- Cases where you were responsible for causing the
premises accident
- Cases where the attorney is being paid by hourly
retainer, or you are acting as your own attorney
- Cases where the settlement will be paid by a person
rather than an insurance company
- Cases where the plaintiff (injured party) is a minor (under
18 years of age)
Your premises accident lawsuit advance
can be used any way you choose, but we recommend that it be used to
meet your basic living expenses (e.g. mortgage, rent, utilities, car
payments, food) or to assist with medical bills from your premises
accident injuries during your recovery. Your premises accident
lawsuit advance can also be used to fund expenes associated with your
case such as expert witness fees.
The documents we need to see for premises accident lawsuit funding
